Ongoing requirement for Marketplace notification

The Affordable Care Act requires employers to notify employees of the existence of the Health Insurance Marketplace.  Employers had until October 1 to notify employees.  However, the notification requirement continues for new hires.

Employers must provide the notice to employees upon hire.  Beginning in January, employers have 14 days to issue the Marketplace notification to new hires.  The notice must be given to all employees even those which are not benefits eligible.

The Department of Labor has stated there is no penalty for failing to provide the notice.
